Groom principal Xavier Baker was quoted in the Law360 article, “3 Argument Sessions Benefits Attys Should Watch In Dec.,” where he provided insights on the potential legal implications of a pivotal Supreme Court case addressing state bans on gender-affirming care.
According to Law360, Baker said that “the justices’ decision ‘will determine whether gender-affirming care, like abortion after Dobbs, is left to the states.’”
“Such a ruling not only could open the door for more states to enact similar limitations, but also might embolden the new Congress to pursue a federal law banning gender-affirming care,” he said. “If the court strikes down the ban, however, then it will be difficult for most, if not all, current limitations on gender-affirming care to continue because the laws would need to satisfy heightened scrutiny.”
