Groom principal Jennifer Eller spoke with Bloomberg Law for their article, “9th Cir. AT&T Ruling ‘Watershed Moment’ for Benefit Contractors,” where she discussed a circuit court ruling where the plan in question entered into prohibited transactions when it amended its existing recordkeeping contracts and the court’s query as to whether the plan provider qualified for exemptions.

Noting it as a “key outstanding question,” Eller asked, “What interest does a plan provider have to take in the outside compensation its service providers receive?”
