Groom principal David Kaleda was quoted by Law360 in the article, “High Court’s Cornell Ruling Eases Path For ERISA Suits,” where he shared his thoughts regarding the potential impact of the Supreme Court decision on employers facing ERISA litigation.
“It’s a pretty frustrating outcome,” said Kaleda.
According to Law360, he said that “the ruling ‘isn’t going to help stem the tide’ of ERISA litigation targeting employers’ retirement plan management.”
“It may be harder to succeed on the motion to dismiss, or it may result, at least, in a lot more protracted motion to dismiss process,” Kaleda added.
